The Dubai International Financial Centre (DIFC) is a prominent business hub with an independent judicial system based on common law principles. The DIFC Courts handle a wide range of civil and commercial disputes, particularly those involving international businesses. When a judgment is issued by the DIFC Courts, understanding how to enforce it is crucial, especially if execution is required outside the DIFC in Dubai or the broader UAE. 

Enforcing a Judgment within the DIFC

If the debtor’s assets are located within the DIFC, enforcing the judgment is relatively simple. The judgment creditor can file an enforcement application with the DIFC Courts, seeking measures such as asset seizure or bank account garnishment within the DIFC jurisdiction. 

Enforcing a DIFC Judgment in Dubai

When the debtor’s assets are outside the DIFC but within Dubai, enforcement requires coordination with the Dubai Courts. This is made possible by the judicial cooperation agreement between the DIFC and Dubai Courts, established under Dubai Law No. 12 of 2004, and supplemented by Dubai Law No. 16 of 2011. 

The process generally involves: 

  • Filing the DIFC judgment with the Dubai Courts. 
  • The Dubai Courts enforce the judgment as if it were their own, without re-examining the case. 

Key requirements for the Dubai Courts to enforce a DIFC judgment include: 

  • The judgment must not violate UAE public policy. 
  • The DIFC Courts must have had proper jurisdiction. 
  • The judgment must be final, meaning no further appeals are possible. 

Once these conditions are met, the Dubai Courts’ Execution Department will proceed with enforcement actions such as freezing bank accounts or seizing property located in Dubai. 

Challenges in Enforcement 

While the framework for enforcing DIFC judgments in Dubai is well-established, challenges can arise: 

  • Objections by the Debtor: Debtors may raise objections to delay the process. Although these are typically addressed by the courts, they can cause delays. 
  • Jurisdictional Complexity: If assets are located across different jurisdictions, further legal steps may be required to enforce the judgment in multiple locations.
